These terms govern your use of luvmuggs.com and every order you place on it. Placing an order means you accept them, so please read them — they are the actual terms, written to be read, not a summary of something longer.

1. Who we are

luvmuggs.com is operated by LuvMuggs, an online drinkware retailer.

Goods are dispatched from the warehouse, not from the business office.

2. About these terms

• These terms apply to every order placed on luvmuggs.com and to your use of the website.
• Our Shipping Policy, Refund & Returns Policy, Payment Methods page and Privacy Policy form part of these terms.
• If anything in those pages conflicts with these terms, these terms apply, except where the conflicting page gives you more protection.

3. Who can order

• You must be at least 18 years old, or have the permission of a parent or guardian, to place an order.
• Orders must be for delivery to an address in the United States that FedEx serves. We cannot deliver outside the United States or to freight forwarders.
• You must give accurate contact, billing and delivery details.

4. Products and descriptions

• We resell drinkware made by third-party manufacturers. Where the maker brands the product, the listing names it; where the maker does not, the listing says so rather than inventing a name. We do not sell those items as LuvMuggs own-brand products.
• Every listing carries the GTIN / UPC issued for the product, which we check against the goods when stock arrives at our warehouse.
• LuvMuggs is not affiliated with, endorsed by, or an official store for any of the brands whose products we resell. Trademarks belong to their owners and are used only to identify the goods.
• Specifications such as capacity and material are the manufacturer’s own. Where a figure is not published, the listing says so.
• Product photographs show the item as supplied. Colours can look slightly different on different screens, and small variations in glaze, speckle and painted detail are normal for ceramics and are not defects.

5. Prices and import duty

• All prices are in US dollars.
• Because orders ship from Hong Kong into the United States, every order carries a 10% import duty and customs handling charge. That charge is already included in the price shown for each product. It is not added at checkout, and nothing further is payable on delivery.
• The only charge added at checkout is delivery: $45 per order, or free once the goods total reaches $800 after any discount.
• Prices can change. The price that applies to your order is the price shown when you placed it.
• If a product is listed at an obviously wrong price because of an error, we will contact you before dispatch and give you the choice of paying the correct price or cancelling for a full refund.

6. Placing an order and when a contract is formed

1. You place an order Your order is an offer to buy the items in it at the prices shown.
2. We confirm we received it The order confirmation email confirms receipt and payment; it is not yet acceptance of the order.
3. We accept it by dispatching A contract is formed when we send the dispatch confirmation with your FedEx tracking number.

We may decline an order before dispatch if an item is out of stock, a price was listed in error, we cannot deliver to the address, or we suspect fraud. If we do, we refund you in full straight away and tell you why.

7. Payment

• We accept Visa, Mastercard, American Express, Discover, Diners Club, PayPal, Shop Pay, Apple Pay and Google Pay. Details are on the Payment Methods page.
• Payment is taken in full when the order is placed.
• If a payment is declined, reversed or charged back, we may cancel the order or suspend dispatch until it is resolved.
• Card details are processed by the payment provider on its own encrypted page and are never stored by LuvMuggs.

8. Delivery

• Orders are handled within 3 business days of payment clearing and carried by FedEx in 2–7 business days, so a typical order arrives in 5–10 business days.
• FedEx is the only carrier we use. Delivery times are estimates; customs inspections, weather and public holidays can affect them.
• Risk of loss or damage passes to you when the parcel is delivered to the address on the order. Ownership passes once we have received payment in full.

9. Returns, refunds and cancellations

• You may return an eligible, unused item in its original packaging within 30 days of delivery. Returns must be arranged by email to support@luvmuggs.com and need a return authorisation number.
• Return postage for a change of mind is paid by you. Items that arrive damaged, faulty or incorrect are put right at our cost.
• There is no restocking fee. Refunds are issued to the original payment method within 5 business days of the return being approved.
• An order can be cancelled for a full refund until it has been packed.

10. Accounts

• You can order as a guest or with an account. An account keeps your addresses and order history in one place.
• You are responsible for keeping your sign-in details private and for activity on your account. Tell us straight away if you think someone else has access to it.
• We may suspend or close an account that is used for fraud, abuse or to break these terms.

11. Using this website

You may browse the site, buy from it and share links to it. You may not:

• scrape, copy or harvest the site at a rate that degrades it for other people;
• reuse our product descriptions, photographs or page content commercially without permission;
• try to gain access to accounts, systems or data that are not yours;
• use the site to break the law or to send spam or malicious code.

12. Intellectual property

The LuvMuggs name and logo, the design of this website and the product descriptions and guides we have written belong to LuvMuggs. Manufacturer names, logos and trademarks belong to their owners and appear only to identify the goods we sell.

13. Our responsibility to you

• We are responsible for supplying goods that match their description and are fit for ordinary use.
• We are not responsible for losses that were not reasonably foreseeable when you placed the order, for business losses, or for damage caused by using a product contrary to the manufacturer’s instructions — for example, microwaving a mug with metallic decoration or putting a vacuum-insulated mug in the dishwasher.
• Where the law allows, our total liability for any order is limited to the amount you paid for it.
• Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or any other liability that cannot be limited by law, and nothing affects your statutory rights as a consumer.

14. Events outside our control

We are not responsible for delays or failures caused by events outside our reasonable control, such as severe weather, carrier or customs disruption, strikes, or public-health or government restrictions. If one affects your order, we will tell you and, if the delay is significant, you may cancel for a full refund of anything not yet delivered.

15. Governing law and disputes

These terms are governed by the laws of the State of California, United States. If you have a complaint, please contact us first — most problems are resolved within a few days by email. Any dispute that cannot be resolved that way falls under the jurisdiction of the courts of California, without affecting any right you have to bring a claim where you live.

16. General

• Changes: we may update these terms. The version in force for your order is the one published when you placed it.
• Severability: if any part of these terms is found to be unenforceable, the rest continues to apply.
• No waiver: if we do not enforce a right straight away, we can still enforce it later.
• Transfer: you may not transfer your rights under an order to someone else without our agreement.
